The Purpose of Trusts

The purpose of a Trust is to safeguard you and your families’ assets, allowing you to plan effectively for passing them on to whomever you wish in the future. A Trust can be set up during your lifetime or it can be included in your Will should you pass away.

Whatever your needs we can advise you on the key details, including how a Trust works, and the tax implications involved in setting one up. We will also go through how the responsibilities work as a trustee.

You may wish to set up a Trust for several reasons, including:

  • For an under 18-year-old who is too young to handle their affairs.
  • to control and protect family assets.
  • to pass on assets when you die.
  • to pass on assets while you are still alive.
  • to protect assets from unwise decision making.
  • when someone cannot handle their affairs because they are incapacitated.

Our in-house experts will help you to determine the type of Trust you need, based upon your intentions and specific circumstances.

Types of Trusts

We can advise and assist you to set up a range of different Trusts, including:

  • Bare Trusts.
  • Discretionary Trusts.
  • Mixed Trusts.
  • Settlor-interested Trusts.
  • Vulnerable Beneficiary Trusts.
Estate Planning

By planning for the future, you can reassure yourself of what will happen to your wealth and assets going forward. Our Solicitors can provide their expertise and advise you on a range of areas, such as:

  • Wills & LPAs.
  • Lifetime Trusts.
  • Life Interest Trusts.
  • Compensation Protection Trusts.
  • Care Home Fees.

Deciding which Trust will suit your individual needs can seem confusing, which is why our Trusts Solicitors are here to advise you on all the options and to explain which one will best fit your requirements.

Trust Disputes

A Trust dispute is a conflict that challenges the administering or validity of a Trust. This could be from disagreements over the value of the Trust, differences of interpretations or a feud between beneficiaries of a Trust. Negligent or fraudulent trustees can also do lasting harm to a Trust and its assets.

If you are engaged in a dispute regarding a Trust, our team can assist. We will aim to resolve your dispute swiftly and we will explain the options available to you.

Our Fees

Where possible we will offer a fixed fee, so you will know what the costs are from the start. For more complex or uncertain projects, we will provide you with an estimate of the likely fees involved and keep you updated throughout the matter.
